
In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties in force in Mexico (the “Law”), we hereby inform you that this Personal Data Privacy Notice (the “Notice”) describes how Toulet & Gottfried Abogados, S.C., with registered address at Tomás A. Edison Street No. 1510-201, Ciudad Juárez, Chihuahua, and its affiliated companies and/or business units or branches (“T&G”), may collect and use information provided by you through various means, for the purpose of facilitating the administrative and employment management of employees.
For What Purposes Will We Use Your Personal Data?
Toulet & Gottfried Abogados, S.C., continuously committed to improving the quality of its employment relationships with its employees, is responsible for the processing of the personal data provided by you, as well as for its use and protection. Pursuant to this Notice, T&G may, among other actions, collect, use, share, store, transfer, and disclose such data to authorities or third parties.
The personal data we collect is necessary to verify and confirm your identity; to administer and operate human resources processes within the company; for internal control of knowledge and professional skills; to comply with obligations arising from the employment relationship with T&G; to create employment and medical files; to contact family members, economic dependents, and/or beneficiaries in case of emergency; and to comply with the provisions established by applicable laws and regulations of institutions such as the Mexican Social Security Institute (IMSS), the National Workers’ Housing Fund Institute (INFONAVIT), the National Retirement Savings System Commission (CONSAR), and the Tax Administration Service (SAT).
What Personal Data Do We Collect and Use?
T&G may collect and, where applicable, process the following personal data: full name; date of birth; age; gender; marital status; nationality; address; copy of official photo identification (passport, voter ID, professional license); résumé (CV); employment application; marriage certificate; INFONAVIT withholding notice; bank account opening agreement; driver’s license; credit bureau report; medical examinations; certificates of no criminal record; copy of birth certificate; copy of proof of address (electricity, telephone, or property tax receipts); copy of military service card (if applicable); home and mobile phone numbers; copy of Federal Taxpayer Registry (RFC); copy of the Unique Population Registry Code (CURP); social security number; educational certificates or proof of studies; language proficiency certificates; employee category (level) and position; photograph; personal references; emergency contact information; employee performance information; records of previous employment; copy of AFORE affiliation certificate; and letters of recommendation.
What Sensitive Personal Data Do We Use?
In addition to the personal data mentioned above, and for the purposes set forth in this Privacy Notice, we may process the following sensitive personal data, which requires special protection: past, present, and future health status; illnesses; allergies; medications taken at the time of signing the relevant employment contract; patrimonial and financial data and credit history; copy of marriage certificate (if applicable); copy of immigration document (if applicable); salary, compensation, and deductions; copy of IMSS registration, termination, or salary modification certificate; copy of compensation certificates from previous employment; information related to beneficiaries or economic dependents, which may include full name, date of birth, and other identification data such as copies of birth certificates; and copies of mortgage credit certificates (INFONAVIT). Such data will be processed as sensitive personal data in accordance with the guidelines established by law.
With Whom Do We Share Your Personal Data?
As a result of the employment relationship, T&G may share your personal data with third parties when necessary for human resources administration, social welfare, and employee benefits, such as physicians, clinical laboratories, insurance companies, administrators of vouchers or discount cards, grocery, gasoline, food, and retirement plans, savings funds, and labor unions, to the extent permitted by law. Such third parties are obligated to comply with applicable privacy laws independently.
In all cases, we will communicate this Privacy Notice to recipients of your personal data so that they may respect its terms. Likewise, T&G may disclose your personal data in response to requests from competent authorities.
By virtue of your status as an employee of T&G, you expressly consent that the collected information (personal and sensitive data) may be transferred to external professional advisors such as physicians, clinical laboratories, retirement plan administrators, and savings funds as mentioned above. If you do not wish for your personal data to be transferred to other companies within the T&G corporate group, you have the right to express such objection by completing the corresponding ARCO Rights Request Form, available through the Human Resources Department or with Lic. Angélica Zajury Ramírez Burciaga.
Any disclosure or transfer of data shall be subject to your express consent as provided herein, in accordance with applicable law.
How Can You Access, Rectify, Cancel, or Object to the Use of Your Personal Data?
You have the right to know what personal data we hold about you, how we use it, and the conditions under which it is processed (Access). You also have the right to request correction of inaccurate or incomplete data (Rectification); request deletion of your data when it is not being processed in accordance with legal principles (Cancellation); and object to the use of your data for specific purposes (Objection). These are known as ARCO Rights.
To exercise these rights or revoke your consent, you must submit a request. For information on procedures and requirements, you may contact our Human Resources Department, which will process such requests and address any questions regarding the handling of your information.
